Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the FleetConnect website, mobile apps and fleet-management platform (the “Services”), provided by FCG Intel Pty Ltd (ABN [__]) (“FleetConnect”, “we”, “us”). By creating an account or using the Services, you agree to these Terms. If you are agreeing on behalf of an organisation, you confirm you have authority to bind that organisation.

1. Accounts & eligibility

  • You must provide accurate account details and keep your credentials secure.
  • The first account created for an organisation becomes its Tenant Admin and may manage users and roles.
  • You are responsible for all activity under your account and for your users’ compliance with these Terms.
  • The Services are for business use; you must be legally able to enter into a contract.

2. Plans, trials & billing

  • Paid plans, entitlements and billing intervals are as shown at signup or in your order.
  • Free trials (where offered) convert to a paid plan unless cancelled before the trial ends.
  • Fees are billed in advance and, unless required by law, are non-refundable for partial periods.
  • Paid plans are invoiced and paid by bank transfer; we do not take or store card details.
  • We may change fees on prospective notice; continued use after the change means acceptance.

3. Acceptable use

You agree not to:

  • use the Services unlawfully or to infringe the rights of others;
  • attempt to gain unauthorised access, disrupt, or reverse-engineer the Services;
  • upload malicious code or data you have no right to process; or
  • resell or provide the Services to third parties except as expressly permitted.

You are responsible for obtaining any consents required to collect and process driver and vehicle data.

4. Your data

You retain all rights in the data you or your devices submit (“Customer Data”). You grant us a limited licence to host, process and display Customer Data solely to provide and improve the Services and as described in our Privacy Notice. We act as your service provider / Data Processor for Customer Data.

5. Intellectual property

The Services, including all software, content and trademarks, are owned by FCG Intel Pty Ltd or its licensors. FleetConnect and the FleetConnect logo are trademarks of FCG Intel Pty Ltd. We grant you a non-exclusive, non-transferable right to use the Services during your subscription. No other rights are granted.

6. Third-party services & devices

The Services work with third-party GPS devices, imported fuel-card data and maps. Your use of those is subject to the third party’s own terms, and we are not responsible for third-party products or availability.

7. Availability & support

We work to keep the Services available but do not warrant uninterrupted or error-free operation. Support is provided per your plan. We may modify or discontinue features with reasonable notice.

8. Warranties & disclaimers

Except as expressly stated and to the extent permitted by law, the Services are provided “as is” without warranties of any kind. Nothing in these Terms excludes rights you have under the Australian Consumer Law or other laws that cannot lawfully be excluded.

9. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental or consequential loss, or loss of profits, revenue or data. Our total aggregate liability arising out of the Services is limited to [the fees you paid in the 12 months before the claim]. Where liability cannot be excluded (e.g. under the Australian Consumer Law), our liability is limited to re-supplying the Services or paying the cost of re-supply.

10. Suspension & termination

  • You may cancel your subscription at any time from your account; access continues until the period ends.
  • We may suspend or terminate for material breach, non-payment, or risk to the Services or others.
  • On termination, your right to use the Services stops; you may export Customer Data for a limited period.

11. Governing law & disputes

These Terms are governed by the laws of [State/Territory, Australia] for Australian customers and [applicable jurisdiction] for Indian customers, and each party submits to the courts of that jurisdiction. The parties will try to resolve disputes in good faith before commencing proceedings.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified through the Services or by email; continued use after the effective date means you accept the updated Terms.
